Terms of Service

This is a legal agreement between the Customer and Location Management Services (“we”, “us”, “our”) for the use of our service. By using our service, you agree to be bound by the terms and conditions of this agreement. If the Customer does not agree to this agreement, the Customer may not use our service.

Definitions

  • Personal account – refers to the service provided as a user account commonly used for personal use or by small companies.

  • Hosted software – denotes the service provided as a SAAS (Software as a Service) solution commonly used to start a GPS tracking business or manage large fleets.

  • Update – constitutes a revision or patch that improves the functionality of the Personal account or Hosted software service, and may include new features or enhancements.

General Terms

  • Copying or distributing any material contained on the website is not permitted.

  • Covert tracking is prohibited. Our service must not be used to track a person without their consent or an object without the owner’s permission.

  • The service must not be used for illegal purposes. It is your responsibility to ensure that your use of GPS tracking complies with local, state, and federal Australian laws.

  • Automated requests to our website, attempts to circumvent our authentication measures, reverse engineering our software or protocols, and engaging in activities deemed damaging to our service are strictly forbidden.

  • Personal account or Hosted software services are non-transferable, and funds are non-refundable.

  • We reserve the right to terminate any account or service without providing a reason. If an account or service is terminated, any current or pending purchases will be refunded or cancelled.

Ownership

  • Software and source codes are the property of Location Management Services. Source code files are not provided.

Technical Support

  • Location Management Services agrees to provide the Customer with technical support services, which include the periodic distribution of bug fixes and minor enhancements as Updates. Technical support email inquiries are accepted at any time and will be answered during normal business hours, Monday to Friday, 8:30am – 4:30pm. We aim to respond to inquiries within 12 hours for requests from Monday to Friday. For weekend requests, we will respond within 24 hours or the following Monday.

Up-time

  • Location Management Services guarantees 99.99% server uptime, excluding scheduled maintenance, emergency maintenance, DDoS attacks, force majeure, and hardware failures within your server.

Updates

  • All Personal account and Hosted software updates will be installed automatically after release without any extra fee or notice to the Customer.

History Period

  • Personal account and Hosted software history data is kept for 90 days. LMS also takes backups for customers, stored for up to 12 months at no charge. This service must be requested by the customer, and any backup data will be available to the customer upon request.

Payment and Service Delivery

  • Personal account – The purchased plan will be added to the account automatically or within 24 hours by our support team. Once assigned, licenses can be used at any time and will not expire. The object will be active one year from the activation date.

  • Hosted software – Will be prepared and activated within 24 hours if payment is received from Monday to Friday. If payment is received during the weekend, it will be activated the following Monday. All access details will be sent via email.

Warranties

  • The services are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the services will be uninterrupted, timely, secure, or error-free.

Limitation of Liability

  • Location Management Services shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

Privacy Policy

  • We take your privacy seriously. By accepting the Terms of Service, you agree to be bound by our Privacy Policy.

Changes

  • Location Management Services may change this agreement at any time for any reason by posting the modified agreement on our website.
